WILLS & ESTATES SERVICES
01| Estate Planning
Estate planning ensures your assets are distributed according to your wishes, providing security and clarity for you and your loved ones.
Beyond drafting a Will, a well-structured plan considers the complexities of your financial, personal, and family circumstances, with a tailored approach to protect your legacy.
A comprehensive estate plan includes:
-
Wills – Guarantees your assets are passed on as intended.
-
Enduring Powers of Attorney – Appoints trusted individuals to manage your financial and/or personal affairs if you are unable to.
-
Appointments of Medical Treatment Decision Maker – Ensures your healthcare choices are respected.
-
Binding Death Benefit Nominations – Directs your superannuation benefits to your chosen beneficiaries, ensuring they are distributed according to your wishes. For those with significant assets or complex family structures, Testamentary Trusts offer greater control, safeguarding inheritances from risks such as creditor claims and family disputes while ensuring long-term wealth preservation.
Superannuation falls outside your estate, making structured nominations essential to align with your broader plan—reducing the risk of unintended consequences and enhancing tax efficiency.
With a tailored approach, we help secure your legacy and provide for your loved ones, no matter how complex your circumstances.
02| Estate Administration
Estate administration is the process of managing and distributing a deceased person’s assets, either in accordance with their Will or, if none exists, under intestacy laws. It involves legal, financial, and administrative responsibilities, often requiring a Grant of Probate or Letters of Administration to provide the executor or administrator with the legal authority to manage the estate.

Probate confirms the validity of a Will and allows the executor to:
-
Gather and manage the deceased’s assets.
-
Settle outstanding debts and taxes.
-
Distribute the estate to beneficiaries.
If no Will exists, intestacy laws determine asset distribution, and Letters of Administration are required to appoint an administrator with similar responsibilities.

Administering an estate can be complex, particularly for large estates, business interests, or where disputes arise. Careful handling is essential to ensure legal compliance, manage family dynamics, and address potential challenges to the Will.

Our expertise supports executors and administrators in:
-
Navigating legal requirements, ensuring all duties are fulfilled correctly.
-
Managing tax obligations, including income tax, capital gains tax, and inheritance tax, ensuring compliance and minimising liabilities.
With professional guidance, we help streamline the estate administration process, ensuring the deceased’s wishes are honoured, legal obligations are met, and assets are distributed fairly and efficiently.
